Requirements Before Getting Married In NY

By Marla Mills

Marriage is an important step for anyone and there are many things that revolve around this process. Before you can get married, there are always a set of requirements that one needs to meet in almost all societies. The same is not different when you are getting married in NY City. For starters, it is important to understand that you must be of legal age to even start planning for a marriage ceremony.

Because the licenses can only be issued by the city or town clerk within the state, it is important to find out what the rules are before going to the clerk. For starters, age is a serious aspect of consideration. Marriage between minors is a serious offense and the state tries to put measures in place to make sure such does not happen.

The age limit is an important aspect. A couple cannot get the licensed if they are below the age of 14. Even for the 14 year old couples, there are consents that they must present before they can get a license to marry. Their parents need to consent in writing and the court must also issue an order to the same consent. Couples of 16 years should also get written consents from their parents.

It is only couples who are of adult age that can get married without the consent of a court or the parents. The requirement of the consents from parents and the court is meant to make sure minors do not get involved in marriages without the guidance of parents. Sometimes teenagers get pregnant and parents decide that it is right for them to marry, if this happens, the parents must give their consents in writing.

When it comes to issuing the licenses, the clerk will have other demands even for couples that are above 18 years of age. Before you can have your licenses, you need to come to the clerk as ac couple. Both couples must be present because the document can only be given in the presence of both and the clerk.

Any marriages after the six months validity period cannot be conducted on the basis of the same license. This means if your event takes more than six months to organize, you will have to make a new application for licensing. The application fees will still apply just as it did in the first case.

It is also good to note that there is a fee that you have to pay for the license. At the moment, this fee is $40. This money is payable at the clerk during the application for the document. The clerk will not issue a license without the payment of these fees. It is thus advisable to make sure you bring the money along when going to the clerk.

For anyone consenting when minors are getting married in NY, it is mandatory that you appear in person at the office of the city or town clerk. Only if a parent is deceased or judged incompetent can a guardian represent them. All these measures are supposed to ensure the couple does not compromise their safety while marrying.
